11. Scaffolds 🗜️ Andamios

  • A worker was installing vinyl siding on a two-story townhome. 
  • He was standing on a ladder that was placed on top of a scaffold.
  • A co-worker was on the scaffold cutting pieces of siding. 
  • The scaffold had no guardrails. 
  • The workers were not wearing any fall protection. 
  • It ends in tragedy, use scaffolds safely.

12. Vehicle Back-Over 🚚 Debido a Vehiculos Retrocediendo

  •  A surveyor was spray painting the ground to outline the area for a new building pad. 
  • At the same time, the driver of a wheel tractor scraper was moving forward to get the ground ready for pad construction.
  • There was no spotter at the site, and there was no internal traffic control plan in place. 
  • A site specific safety plan with worker training can help everyone go home safe.

OSHA GENERAL DUTY CLAUSE

To assure safe and healthful working conditions for working men and women; by authorizing enforcement of the standards developed under the Act; by assisting and encouraging the States in their efforts to assure safe and healthful working conditions; by providing for research, information, education, and training in the field of occupational safety and health; and for other purposes. 

The 'General Duty Clause' below is our favorite law, because it so simply states the mission of what we should all want to do when it comes to safety: 

SEC.5.Duties(a)

Each employer --

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(2) shall comply with occupational safety and health standards promulgated under this Act.

(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.

In our experience, success in demonstrating compliance comes down to four main points (With demonstratable enforcement being the most frequent deficiency):

  • A robust Safety Program in place.
  • Demonstratable enforcement of rules and active monitoring of the work environment.
  • Training on safety hazards and controls with clear communication.
  • Unforeseeable misconduct by the employee.
